Judge Privately Admonishes Prosecutors for Grandstanding at Hearing for White House Correspondents’ Dinner Gunman

A federal magistrate judge privately rebuked prosecutors during a detention hearing for the gunman accused of storming the White House Correspondents’ Dinner, warning them against turning the legal proceedings into a media spectacle — in a rare and pointed rebuke that has drawn widespread attention.

The Courtroom Confrontation

Magistrate Judge Moxila Upadhyaya pulled three prosecutors aside at Thursday’s detention hearing, telling them out of earshot of the public and press: “I don’t know what’s going on here. I know that you want to present your case, I guess, to some audience other than the Court. I don’t want this to turn into a circus.” CNN

The judge’s private remarks were later made public after a transcript of the bench exchange was included in the court docket, following a request from CNN.

At the hearing, prosecutors arrived prepared to show newly obtained video footage and photographs of the shooting, Allen’s weapons, and the hotel crime scene. Judge Upadhyaya stopped them from presenting this evidence in open court, ruling that it was unnecessary after Allen’s defense lawyers confirmed he agreed to remain detained while awaiting trial. Following the hearing, the U.S. Attorney’s Office placed the videos and photos into the court record and posted them on social media, stating in a letter to the judge that the Justice Department “now formally completes the record.” KRDO

Background: Who Is Cole Tomas Allen?

Cole Tomas Allen, 31, of Torrance, California, was arraigned in U.S. District Court on charges stemming from the April 25 shooting at the White House Correspondents’ Association Dinner. He faces one count of attempted assassination of the President of the United States, transportation of a firearm and ammunition in interstate commerce with intent to commit a felony, and discharge of a firearm during a crime of violence. U.S. Department of Justice

Allen was an educator from Torrance, California, who held an engineering degree from a prestigious university. He was charged in federal court with three counts, including attempting to assassinate the president. Specifically, Allen earned a degree in mechanical engineering at Caltech in 2017 before going on to receive a master’s in computer science at California State University, Dominguez Hills, in 2025. What Happened at the Dinner

Shortly before 8:40 p.m. on April 25, Allen approached a security checkpoint on the Terrace Level of the Washington Hilton hotel leading to the ballroom where the dinner was underway. He ran through the magnetometer holding a long gun. A U.S. Secret Service officer, wearing a ballistic vest, was shot once in the chest. That officer drew his service weapon and fired multiple times at Allen, who fell to the ground and suffered minor injuries but was not shot. U.S. Department of Justice

Video evidence later reviewed by CNN shows Allen coming back through a door and sprinting toward a group of law enforcement officers at the security checkpoint. One Secret Service officer noticed Allen several seconds before the others, drew his pistol and aimed it toward Allen. Almost instantaneously, Allen ran through a remaining magnetometer and leveled his shotgun at that Secret Service officer. KRDO

Allen’s Planning and Alleged Motive

On April 6, Allen made a reservation at the Washington Hilton for three nights. He traveled by train from his home near Los Angeles to Chicago before boarding a train to Washington, D.C., arriving on April 24. U.S. Department of Justice

Shortly before the attack, Allen sent an email to members of his family and a former employer explaining the actions he was about to take. He signed the email “Cole ‘coldForce’ ‘Friendly Federal Assassin’ Allen.” U.S. Department of Justice

The FBI affidavit in support of the charges states that Allen’s letter specified grievances against Trump administration officials and policies, referencing immigration detentions, alleged extrajudicial killings, and other issues. The letter also contained an apparent reference to Trump stating Allen was “no longer willing to permit” certain conduct. NPR

Allen sent some of his writings to family members before the attack, and one of them alerted police about the writings. The writings sent to family members apparently did not specifically mention the White House Correspondents’ Dinner. CBS News

The Political Backdrop to the Courtroom Tension

Judge Upadhyaya’s admonishment highlights a broader dynamic that has emerged in the days since Allen was taken into custody, with Trump administration officials aggressively describing their theory of the alleged attempted assassination in news interviews and unsolicited court filings. CNN

Serving as the backdrop to the admonishment is the political pressure some officials find themselves under, as Trump has signaled increased openness to replacing those who he believes do not react quickly and publicly enough to sensitive investigations. KRDO

Several top Justice Department officials — including acting Attorney General Todd Blanche, FBI Director Kash Patel, and D.C. U.S. Attorney Jeanine Pirro — were guests at the dinner on the night of the shooting. Some were escorted out of the banquet hall as law enforcement secured the scene, and were still in formal attire as they spoke at a news conference shortly after. “This one hits a little differently. We were all there,” one official noted. CNN

Prosecutors Respond

In response to the judge’s bench remarks, prosecutor Jocelyn Ballantine told the judge: “We’re five days into this investigation. As soon as we have finalized reports and discovery that we’re in a position to be able to accurately provide to counsel, we will be doing that. We take our discovery obligations seriously.” KRDO

The case is expected to result in additional charges, and legal proceedings are ongoing. The courtroom episode has raised broader questions about the boundary between prosecutorial duty and public political messaging in high-profile federal cases — a tension that legal observers say is rarely so openly acknowledged by the bench.
